Married parents automatically share all custodial rights for their own children. But during divorce, parents must re-determine these rights. What rights you hold afterwards will depend on the nature of your child custody order. Everything comes down to those pieces of paper.

A custodial parent is a parent who is given physical and/or legal custody of a child by court order. A child-custody determination means a judgment, decree, or other order of a court providing for the legal custody, physical custody, or visitation with respect to a child.

Child Custody rights are determined by a court or by a mediation agreement by the parents of the child. A parent can file for custody, which generally consists of motions and/or petitions, to establish custody. In many jurisdictions, upon the filing of custody papers, the court may refer the matter to mediation first, to determine if the parents are agreeable on legal and physical custody of the child. If an agreement to custody cannot be reached, typically the case will be set for a court date before a judge to decide upon the custody of the children, parenting time, visitation, supervised visitation, no-move orders, and child support. The court will then issue an order stating who will be the primary parent, and possibly other issues. Once a custody order has been issued, both parents are then in a better position to protect and enforce their custodial rights. This results in much less confusion.

A solid and well-defined court order, can eliminate a lot of confusing issues, now, and in the future and help avoid confrontations between the parents. After all,the real goal is to be able to move forward in life with as little stress as possible, for all parties involved.
